Alexandra Monaghan successfully defends rape allegation in the youth court .

Alexandra was instructed to represent M, who was 16 years old at the time of the alleged incident but had reached his 18th birthday by the time of trial. M was charged with two counts of rape (vaginal and oral) and one count of sexual assault by penetration. The case was tried in the youth court across four days.

The allegations arose between two former friends after a mutual friend’s birthday party. The complainant alleged that M purposefully stayed after other’s had left her home with the intention of raping her.

The Crown’s case was that M had previously been spoken to at school for following the complainant; a suggestion that was challenged extensively by Alexandra both in cross-examination of their teachers and through disclosure requests which resulted in agreed facts confirming no relevant documentary evidence existed to support the suggestions made by the prosecution witnesses.

Ultimately, M was found not guilty of all three counts.
