Alexandra Monaghan, instructed by the Royal College of Nursing, acted for a nurse facing several allegations, including allegations of dishonesty.
Following evidence from six witnesses called on behalf of the NMC, Alexandra was successful in making a submission of no case to answer in respect of allegations concerning the nurse attending work whilst unfit for duty, and a clinical error relating to medication administration.
The nurse also faced an allegation of consuming liquid morphine whilst on duty and associated dishonesty in stealing the medication from her employer. The NMC relied on the evidence of a healthcare assistant, whose evidence was that she had clearly seen the nurse consuming the medication on the ward during the medication round, as well as evidence from colleagues who had interacted with the nurse both before and after she was alleged to have drunk the medication.
Following careful cross-examination of the NMC’s witnesses, the nurse’s evidence and Alexandra’s closing submissions on facts, the Panel found all allegations not proved.
