Briony Molyneux's Client Acquitted of Serious Sexual Offences.
27 August 2024
Briony Molyneux’s client has been unanimously acquitted of all four serious charges following a trial at Snaresbrook Crown Court. Briony’s client faced charges of rape, assault by penetration and two counts of sexual assault. The allegations concerned the defendant’s work colleague, and related to matters dating back to 2019.
If he had been convicted, Briony’s client would have faced a significant prison sentence, likely ranging into double figures. As a result of Briony’s hard work, her grateful client cleared his name of all wrongdoing and was able to maintain his good character.
It was the Prosecution case that the Defendant had befriended the Complainant during their shifts at a local youth centre. The Crown said that he had groped her inappropriately at work, and that they had met up outside work after shifts on three occasions.
It was said that on the first occasion he had sexually assaulted her by penetration near a park, and then on the second meeting he had gone on to sexually assault and rape her in a children’s playground.
There were complexities involved with the Complainant having to be flown back to the country, having moved abroad, and in her being an individual with multiple neurodivergent conditions.
Briony’s extensive experience of dealing with vulnerable witnesses with a large spectrum of presentations allowed her to defend her client vigorously, whilst still maintaining fairness for all parties.
Instructing Solicitors Sonn Macmillan Walker played a big part in the successful result having worked closely with Briony in the preparation of the case before trial.
