Justin Yang successfully defends first ever prosecution under the Package Travel and Linked Travel Arrangements Regulations.

Justin represented one of two company directors of a travel agency in a prosecution initiated by Trading Standards at Brent and Harrow Council.

This was the first case brought under the Package Travel and Linked Travel Arrangements Regulations 2018. Following the winding up of the travel agency, the directors were charged on a five-count indictment under the Regulations and also the Consumer Protection from Unfair Trading Regulations 2008.

In scrutinising the evidence, Justin focused on the interpretation and application of "consent and connivance" as it applies to assigning individual criminal responsibility on company directors. The council ultimately offered no evidence against Justin's client. They also offered no evidence against the other director, insofar as he signed an Enterprise Act undertaking and paid full compensation to the complainant.
