Laura Herbert successful in appeal against CQC decision.

Laura Herbert recently succeeded in a High Court Appeal against a decision made by the Care Quality Commission (CQC) to refuse to vary the location of a "Personal Care" provider.
Following a two-day appeal hearing the Specialist Tribunal determined that the Appellant, a provider of Personal Care, had provided sufficient evidence to demonstrate that it intends to comply and will comply with the regulatory requirements. Laura successfully challenged the CQC assertions that the provider's current risk profile at other locations run by the provider were ‘high’ despite a lack of inspection by the CQC for some 11 and 26 months.
