Laura Herbert successfully obtains discharge of European Arrest Warrant.

Laura Herbert, an extradition law specialist, has successfully obtained a discharge of one of two European Arrest Warrants issued by Poland, on the grounds that it would be a disproportionate breach of her client’s rights under Article 8 of the European Convention on Human Rights (Article 8 ECHR). The discharged Warrant had been issued for offending which took place in 1997, and the client had served all but 5 months of their sentence.

The CPS Extradition unit has sought permission to appeal the District Judge’s decision. Following her success at first instance, Laura has been instructed to defend the appeal before the High Court.
