Kathleen Mulhern’s client acquitted of serious assault against rickshaw driver.

Kathleen represented a security guard who was charged with s20 GBH. The complainant in the case suffered a broken jaw after being struck by her client.
The prosecution alleged that the defendant had followed the complainant, a rickshaw driver, and then punched him in the face. Kathleen’s client admitted following the complainant and striking him with an open palm when the complainant came towards him.
After careful cross examination, and assessment of the CCTV footage, Kathleen submitted to the jury that the defendant was acting in lawful self defence due to the aggressive behaviour of the complainant.
The jury unanimously acquitted the client after just over an hour of deliberation.
