Roxanna Whittaker-Lewis successfully defends defendant accused of multiple breaches non-molestation order.

Roxanna was instructed by Dev Jummoodoo of Rosewood Solicitors to undertake cross examination of two witnesses pursuant to section 36 of the Youth Justice and Criminal Evidence Act 1999. It was alleged that the defendant had breached a Non-molestation Order on two occasions by contacting his own children.

During these proceedings it became clear that the defendant was suffering from a considerable disability and was not able to represent himself effectively. As a result, and to avoid delays, the District Judge extended the Representation Order and requested that Roxanna represent the defendant throughout the whole trial.

Roxanna opposed the inclusion of hearsay evidence, and cross examined both a teacher and a social worker. As a result, she was able to demonstrate that the defendant had a reasonable excuse for the breaches. This resulted in the defendant being found not guilty of all charges.
