Tasmin Malcolm, instructed by Stefan Sutherland of Carson Kaye, secured a unanimous acquittal in a case alleging possession of a firearm with intent to endanger life.

The case concerned a defendant, accused of having gang affiliations, found to be in possession of a loaded shotgun with additional ammunition. The Prosecution alleged that an altercation shortly before police arrival demonstrated that the loaded firearm was intended to be used for a ‘ride out’ to confront the so called rival group. The Defendant disputed having any such intention and was acquitted within an hour of deliberations after a four day trial, thereby removing the option of a life sentence being imposed.

The Defendant will be sentenced at a later date in respect of the simple possession of the firearm and a bladed article to which he pleaded guilty.
