Tasmin Malcolm succeeds before the NMC in dishonesty case.

Tasmin Malcolm, instructed by the RCN, represented a nurse accused of dishonestly creating records to give the misleading impression of having conducted observations which she was accused of not having conducted. After a 5-day hearing, the panel concluded that the on the balance of probabilities they did not find the NMC case proved as the case had been put, despite hearing from the patient that she had not been seen for a period of 7 hours. The only charge found proved related to admitted inaccurate timings on records, which the panel did not find amounted to misconduct.
The newly qualified Registrant had admitted two separate charges relating to a knowledge gap which led to failings on another occasion. After hearing submissions, the panel were satisfied that the Registrant is currently fit to practice, concluding the proceedings before the NMC and allowing the nurse to continue on in her career without restriction.
